Victim Reporting
It is the option of victims of domestic violence, dating violence, sexual assault and/or stalking to notify Administration, Monessen Police Department, and/or the Pennsylvania State Police of any crime committed against them. If you are a victim of domestic violence, dating violence, sexual assault and/or stalking at DEC, your first priority should be to get to a place of safety. You should then obtain the necessary medical treatment as advised by a medical professional. Administration strongly advocates that a victim of violence reports the incident in a timely manner. You can call 911 or DEC’s Title IX Coordinator, Michael Crosby, at 724‐653‐2196. This is a critical factor for evidence collection and preservation. Notifying Administration will not obligate the victim to prosecute, nor will it subject the victim to scrutiny or judgmental opinions from staff. Allegations of sexual assault or rape occurring off campus should be reported to the Monessen Police Department. Efforts will be made to ensure the confidentiality of all reports, except as necessary and required to investigate the alleged offenses. DEC authorities may issue a safety alert to those areas of the campus community affected by the crime. The issuance of this alert will depend on the particular circumstances of the crime. Victims can provide information to the Administration and choose criminal prosecution and/or a referral to the on campus discipline system or report the incident without seeking prosecution.
Procedure for Filing a Complaint for the On‐Campus Discipline System
Any student or employee who believes that he or she has been the victim of a Title IX or VAWA violation should report the incident to DEC’s Title IX Coordinator or any member of DEC’s Title IX Committee. If a student or employee feels more comfortable they may make the initial report to a member of the faculty or administration that they trust. This report should then be made to the Title IX Coordinator as soon as possible. In general, DEC encourages timely reporting, but will investigate all incidents fairly and promptly regardless of when they occurred.
Definitions
Complainant Individual filing a complaint Respondent Individual responding to a filed complaint. Witness an individual who has seen or has personal knowledge regarding the complaint. Upon learning of a Title IX or VAWA violation, the Title IX Coordinator will contact the complainant and schedule a meeting to discuss confidentiality concerns and the investigation process in general. The complainant will be given the option of filing a formal complaint.
If the complainant elects to file a formal complaint against the respondent, the Title IX Coordinator will begin the process by meeting with the complainant and the respondent as necessary. Please note that in some instances Douglas Education Center will be required to investigate, even if the complainant doesn’t wish to file a formal complaint. These include, but are not limited to the following: The increased risk that the alleged perpetrator will commit additional acts of sexual or other violence, such as:
• whether there have been other sexual violence complaints about the same alleged perpetrator;
• whether the alleged perpetrator has a history of arrests or records from a prior Institution indicating a history of
violence;
• whether the alleged perpetrator threatened further sexual violence or other violence against the victim or others;
• whether the sexual violence was committed by multiple perpetrators;
• whether the sexual violence was perpetrated with a weapon;
• whether the victim is a minor;
• whether DEC possesses other means to obtain relevant evidence of the sexual violence (e.g., security cameras or
personnel, physical evidence);
• whether the victim’s report reveals a pattern of perpetration (e.g., via illicit use of drugs or alcohol) at a given location
or by a particular group.
• Whether the perpetrator was a faculty member. At the initial meeting with the respondent, the Title IX Coordinator will
give the student adequate notice of—and an opportunity to review and respond to—the allegations outlined in the submitted complaint. The Title IX Coordinator also will give both parties information about interim measures such as no‐contact orders and academic accommodations if available. In cases in which the respondent student's conduct poses a threat to the DEC community, the Title IX Coordinator may impose an interim suspension that occurs immediately and that lasts until the matter is resolved. If applicable, the Title IX Coordinator and Title IX Committee will meet with witnesses recommended by both the respondent and complainant. Both the respondent and the complainant will have the opportunity to review evidence gathered during the investigation or submitted by the opposing party. If it is deemed necessary that a formal hearing take place, both students also may provide testimony and evidence at the hearing before an unbiased hearing board which will consist of DEC’s Title IX Coordinator and Title IX Committee. These individuals are trained annually on issues related to sexual violence, the hearing process, standards of evidence, credibility, and weight of evidence. Both parties will be allowed to have witnesses at the hearing
